Practice and procedure - Appeal — Excessive punishment

Facts:

Appellate convicted of causing harm to persons and sentenced to 3 months hard labour. He appealed the conviction claiming that he did not harm the person he was convicted of harming, but he harmed a different person, in self defence

Held:

Conviction stands. The court saw no reason to interfere with the conviction, the conclusion reached by the court below was fully supported by the evidence. However, looking at the defendants record, it appeared he had conducted himself properly for the last 10 years, and prior to that time he had a small number of convictions for a different type of offence. It was thought that it would be excessive punishment to send him to prison peremptorily. Therefore the order for imprisonment was to be set aside and a fine of ten pounds substituted therefore.

1 In this case, the appellant appealed against his conviction by the magistrate of the southern district on the 22 ^nd of November, 1967 for the offence of causing harm to one Muriel Williams. He was sentenced to three months' imprisonment with hard labour.
